A graduate of Washington University in St. Louis, and an honors graduate of Georgia State University College of Law, Jim Standard has litigated and tried cases in states throughout the nation, including Georgia, South Carolina, Tennessee, New Hampshire, and West Virginia. Mr. Standard specializes in representing corporations and individuals in a variety of matters, including commercial disputes, professional liability, and insurance coverage disputes.
In 2005, Mr. Standard was an invited lecturer at the Georgia Psychological Association annual meeting and the Institute of Continuing Legal Education seminar on Georgias adoption of new evidentiary rules for expert testimony. Mr. Standard has also been an invited lecturer before a panel of Georgia Supreme Court justices and Court of Appeal judges on evidentiary rules applicable to experts.
Due for publication in late 2005, Mr. Standard is the co-author of the new legal treatise, Expert Testimony in Georgia, published by the nations premier legal publisher, Thompson/West.
Education

Jim Standard received his B.A. in 1991 from Washington University in St. Louis, where he obtained a dual major in Political Science and Economics. Mr. Standard played on the school rugby team, and was a member of the Beta Theta Pi fraternity.
Mr. Standard received his law degree in 1998 from Georgia State University College of Law, where he graduated magna cum laude. Mr. Standard served as the Associate Lead Articles Editor of the Georgia State University Law Review, and was the author of the 1997 article Legislative Review of Georgia's Partial Birth Abortion Ban Act of 1995, published in the Georgia State University Law Review at 14 Ga. St. U.L.R. 250 (1997).
During law school, Mr. Standard was selected as a student member of the Bleckley Inn of Court. In the Summer of 1996, Mr. Standard traveled abroad to study at the Johannes Kepler University School of Law in Austria, where he participated with high honors in the study of international commercial arbitration.
Work History

During law school, Mr. Standard began clerking at Gorby, Peters & Associates, P.C., where he joined as an associate in 1998, and was named partner in January 2005.
Mr. Standard has tried and litigated cases in both federal and state courts throughout the nation. Mr. Standard has successfully handled cases on behalf of corporations and individuals involving commercial disputes, construction litigation, professional liability, products liability, toxic substance liability, motor carrier liability, Premise liability, and insurance coverage.
In addition to his litigation practice, Mr. Standard frequently consults with practitioners in the health care industry in matters of risk management and statutory and regulatory compliance. Mr. Standard also frequently consults with and advises the Georgia Insurers Insolvency Pool, a statutory agency operating under the direction of the Insurance Commissioner, on a variety of business and coverage matters.
Mr. Standard is a frequent author and lecturer. Representative Cases

Commercial Litigation.
Mr. Standard successfully defended a national brokerage firm of construction materials in a lawsuit brought against it by one of the Southeast's largest residential builders. In this matter, the builder contended that product supplied by the brokerage firm, and then integrated into hundreds of homes, was defective, necessitating the expenditure in hundreds of thousands of dollars in repair costs. When the case came to Mr. Standard, the brokerage firm was facing a default judgment, potentially exposing it to the entire costs of repair. Mr. Standard was able to successfully set aside the default, and then successfully defend against the allegations that the product supplied by the brokerage firm was the product necessitating the repairs.
Insurance Coverage.
Representing an insurer which had paid out on a claim involving defective title to real property, Mr. Standard was able to successfully obtain for the insurer reimbursement of the monies paid. In doing so, Mr. Standard exposed and prosecuted, on behalf of the insurer, a "mortgage flipping" ring involved in the defrauding of lending institutions and title insurance companies.
Representing an insurer which had paid out on a catastrophic head injury claim, Mr. Standard was able to successfully convince a trial court in a declaratory judgment action that the insurer's liability was "excess," and that another insurer owed the primary obligation to provide coverage for the claim. In doing so, Mr. Standard was able to obtain for the insurer reimbursement of the amounts it had previously paid out, as well as a declaratory judgment that any future exposure was to borne by the other insurer.
Professional Liability.
Recently, Mr. Standard successfully argued before the Georgia Court of Appeals on a matter of significant national importance - the extent to which a psychologist or other "mandated reporter" can be held personally liable for failing to report possible child abuse. In a professional malpractice action brought by the mother of a little girl against a psychologist for failing to report to police authorities allegations and other potential signs of abuse, the trial court issued a ruling allowing the mother's case to go before a jury. Successfully obtaining an interlocutory appeal from this ruling, Mr. Standard argued that a right to sue a psychologist or other "mandated reporter" for monetary damages should not exist where the mandated reporter makes a good faith determination, based upon their professional judgment, that a report is not indicated. The Court of Appeals agreed, and reversed the trial court's order, resulting in the case being dismissed. This ruling has far-reaching implications for all professionals in the mental health field, as well as other statutorily-designated "mandated reporters," such as physicians, social workers, and teachers.
Mr. Standard successfully defended an Augusta, Georgia-based Ob/Gyn in a so-called "wrongful birth" case. There, after a single mother unexpectedly became pregnant and gave birth to an unwanted child, she sued the physician, alleging that he had negligently failed to perform a requested tubal ligation. In a trial of the case, Mr. Standard obtained a defense verdict on behalf of the doctor, a verdict which was upheld by the Court of Appeals.
Products liability/construction litigation.
Mr. Standard represented a contractor performing renovations to one of Atlanta's major medical centers in a case where an elderly patient sustained catastrophic head injuries as a result of being struck by an allegedly malfunctioning sliding door. Mr. Standard was able to obtain summary judgment for the contractor, resulting in its dismissal from the case, by successfully arguing that the contractor was not involved in the manufacture, design, or installation of the door or its component parts, and could not be legally held accountable for any alleged negligence of others who were so involved.
Motor carrier litigation.
Mr. Standard represented a Fortune 250 company in a case involving its long-haul transportation operations, wherein a collision between the company's tractor-trailer and another vehicle resulted in the death of a young man. Much of the case focused on whether the accident was preventable, and entailed the use of experts in areas such as biomechanics, engineering, pathology, and federal safety regulations. After a hotly litigated motions practice, in which the testimony of the plaintiff's various experts was in large measure excluded, the case settled for a confidential amount just days before trial.
Professional and Community Involvement

Mr. Standard is a member of the State Bar of Georgia, the American Bar Association, and the Defense Research Institute. He is also a member of the Buckhead Business Association and the Sandy Springs Business Association. He is a frequent author and lecturer for the Institute of Continuing Legal Education of Georgia. In 2005, Mr. Standard was nominated to the 2005-2006 Bleckley Inn of Court.

Jim Standard graduated with high honors from Georgia State Law School, where he was Associate Lead Articles Editor of the Georgia State Law Review. Mr. Standard has been practicing law for seven years, and in that time he has appeared in cases in several states throughout the nation, including New Hampshire, South Carolina, Tennessee, West Virginia and Georgia.
Mr. Standard, known for his thoughtful approach and extraordinary work ethic, has tried medical malpractice and psychiatric malpractice cases, and has briefed and argued a variety of motions in state and federal court pertaining to medical and psychiatric negligence, HMO liability, motor carrier liability, Premise liability, and insurance coverage.
